  • Recruitment and workforce placement.

The Candidate can withdraw their consent at any time, without affecting the processing carried out based on the consent before its withdrawal. Consent withdrawal can be done easily by sending an email to office@arcompetence.ro.

!!! From the moment you withdraw your consent, we will no longer be able to use your CV for analysis or to consider you for other recruitment projects for positions similar to the one you initially applied for or for the position/profession/role for which you initially submitted your CV.

If we intend to process your personal data for a purpose other than the one for which it was collected, we will provide you, prior to such further processing, with information regarding the new purpose and any other relevant information requested by you, which includes:

  • The period for which personal data will be stored, according to the criteria used to determine this period;
  • The right to request access, rectification, or erasure of your personal data, to restrict processing, to object to processing, and the right to data portability;
  • Where the processing is based on your consent for one or more specific purposes, the existence of the right to withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal;

Ulierului nr.6, 100046 Ploieşti, J29/3452/13.12.2019, CUI 42020739, phone +40 728 002 635, email office@arcompetence.ro, is a personal data operator as defined by the provisions of Regulation (EU) 679/2016 regarding the protection of individuals concerning the processing of personal data and the free movement of such data, repealing Directive 95/46/EC, known as the “General Data Protection Regulation” or “GDPR”. As such, it collects and processes personal data as follows:

PERSONAL DATA COLLECTED AND PROCESSED

  1. If you are a candidate and wish to be recruited through ACTIVE RESURSE COMPETENCE S.R.L., we will collect and process the following categories of personal data:
    Name, surname, date of birth, age, home address, email address, phone number, marital status, image/photo, occupation, professional experience, previous employment (position, responsibilities, periods), studies/courses completed, hobbies, test results, or others.
  2. If you access the ACTIVE RESURSE COMPETENCE S.R.L. website, we will collect personal data through cookies, as detailed in our Cookie Policy, available in the GDPR section.

PURPOSE OF COLLECTING AND PROCESSING PERSONAL DATA
ACTIVE RESURSE COMPETENCE S.R.L. collects and processes personal data for the following purposes:

  • To carry out recruitment and selection processes, workforce placement, or other human resource activities specific to our company’s operations. The personal data we collect will be limited to the information necessary to achieve this purpose (for example, evaluating your professional potential as a candidate and determining your suitability for the position being recruited).

Recruitment process data will be retained for 6 months from the conclusion of the recruitment/selection process for the position you applied for.

RIGHTS OF THE DATA SUBJECT

Regarding the processing of your personal data under Articles 15-22 of the GDPR, the data subject enjoys a series of rights, as follows:

  • Right of access to data – You can submit a request to confirm whether your personal data is being processed and obtain access to the categories of data processed and additional information related to the processing carried out, or, if applicable, you may request a copy of the personal data being processed;
  • Right to rectification – You can obtain, without undue delay, the correction (rectification) of inaccurate data that we process concerning you;
  • Right to erasure of data (also known as the “right to be forgotten” in the online environment) – You can request and obtain the erasure of personal data, insofar as the applicable legal provisions allow, if the conditions of Article 17 of the Regulation are met, and the processing is based on consent;
  • Right to restrict processing – You can obtain the restriction of processing only in the situations expressly provided by law;
  • Right to data portability – You can receive your personal data in a structured format so that it can be transferred to another operator automatically when the processing is based on consent under Article 6 (1)(a) or Article 9 (2)(a), or on a contract under Article 6 (1)(b), and the processing is carried out by automated means;
  • Right to object – You may object to the processing of your personal data in certain situations, only if the processing is based on the performance of a task carried out in the public interest or on the legitimate interest of the operator;
  • Right not to be subject to automated individual decision-making – You have the right to request and obtain the withdrawal, cancellation, and reconsideration of any decision that has legal effects on you, made solely based on automated processing of personal data;
  • Right to contact the National Authority for the Supervision of Personal Data Processing (ANSPDCP) or any competent court in the field of personal data protection if you believe that your personal data have been processed abusively or illegally, or that your rights have not been fully respected. Your request will be recorded and processed according to internal procedures and the provisions of the Regulation. You will receive a response within 30 calendar days from the receipt of your request, provided that it contains all the data and information necessary for its analysis and resolution, following the GDPR provisions. If it is necessary to conduct a more in-depth analysis, such as retrieving documents from the archive, the one-month period may be extended, but you will be informed of the reasons for the delay and the extended timeframe.

Below, you can find the forms to exercise the rights conferred by the Regulation. If you wish to submit these requests in any other form, they will be analyzed, and a response will be provided following the applicable provisions. Please note that the processing deadlines begin from the date the request is correctly submitted and contains all the data and information necessary for registration and resolution.

ACTIVE RESURSE COMPETENCE S.R.L., as a personal data operator, may amend this personal data processing policy, and it will be updated following legislative changes, internal data processing practices and procedures, website features, etc. If such changes occur, they will be published within the updated policy, and the effective date of the modified policy will be posted at the beginning of the updated Personal Data Processing Information Notice.
